Banking Law & Objections

Objections, enforcement, suspension of auctions and defence of borrowers.

Banking Law is the firm's primary area of expertise. We handle a wide range of cases concerning the borrower–bank relationship, with a focus on timely and effective defence against claims by banking institutions and loan management companies (funds). Our experience covers objections to payment orders, enforcement objections, suspension and annulment of auctions, as well as offensive claims against banks for abusive terms.

Facing a property auction?

What we handle

  • Objection against payment order
  • Enforcement objection and opposition to enforcement actions
  • Suspension and annulment of residential or commercial property auction
  • Claims against banks for abusive contractual terms
  • Fund cases — management of claims by companies such as Dovalue, Cepal etc.
  • Application for exemption of primary residence from auction

Our approach

We do not treat a payment order, seizure or auction as a fait accompli. Every file is examined from the ground up: the claim itself, its transfer, standing, interest, charges, enforcement acts and every avenue of defence or attack. The goal is to shift the balance of power before the borrower is pressured into signing under duress or loses assets without any real scrutiny.
